Case Alert: Marriage of F.M. and M.M. (2021)

Case Summary
August 11, 2021
Description

(1) Courts must allow people requesting DVROs to present evidence about abuse that occurred after they filed the DVRO petition.

(2) The survivor's spoken testimony is enough for the court to issue the DVRO - while more evidence is always beneficial, survivors are not required to bring more evidence than their own sworn word.

(3) A DVRO may not be denied solely because the survivor is living apart from the abuser - physical separation is not a substitute for the protection of a restraining order.
