Description

Under RCW 26.09.191(2)(m)(i), this case discusses the appropriate implementation of mandatory limitations on residential time to consider the survivor's parent’s safety and well-being. It reversed the trial court’s parenting plan, which was entered without adequate consideration of the survivor parent’s safety. Thus, the Opinion establishes that the survivor parent’s safety must be considered, as required by the statute, and cannot be ignored when ordering a parenting plan in cases with a history of domestic violence.
