Description

(1) Courts may not automatically prohibit children from testifying about abuse. Each decision about accepting a child's testimony must be made case-by-case.

(2) In a custody case, courts must consider evidence of abuse affecting other children not part of the case.

(3) Sexual assault against a partner or other children is relevant to any custody case.
